3. No Guarantee of Results

The Mercado Group aims to help you achieve your goals and enhance your skills; however, we cannot guarantee specific outcomes or results. The success of coaching and consulting engagements depends on a variety of factors, including the Client’s commitment and active participation.

4. Client Responsibilities

Clients are responsible for:

  • Actively participating in coaching sessions and consulting engagements.

  • Providing accurate and complete information relevant to the Services.

  • Implementing agreed-upon strategies, plans, or recommendations.

  • Informing us promptly of any changes in personal or business circumstances that may impact the engagement.

5. Fees and Payment

  • Payment Terms: Payment for Services is due according to the schedule agreed upon with The Mercado Group. Payments may be required upfront or in installments, depending on the Service package.

  • Late Payments: Failure to make timely payments may result in the suspension or termination of Services.

  • Refund Policy: Fees are non-refundable unless otherwise specified in writing at the start of the engagement. Refunds for unused sessions or early termination of Services are at The Mercado Group's discretion.

6. Cancellation and Rescheduling

  • Session Cancellation: Clients may cancel or reschedule a session with at least [Insert Number of 24 hours notice. Cancellations made with less notice may result in a forfeited session or applicable fees.

  • Service Cancellation: Either party may terminate the engagement with written notice. Any unused services will be handled in accordance with our Refund Policy.

7. Confidentiality

9. Disclaimers and Limitations of Liability

  • Disclaimers: Our coaching and consulting services are educational and informational in nature. We do not provide legal, financial, medical, or psychological advice, and clients should seek independent advice from licensed professionals when necessary.

  • Limitations of Liability: The Mercado Group is not liable for any direct, indirect, incidental, or consequential damages arising from your use of our Services or reliance on any advice given. Our liability, if any, is limited to the fees paid by the Client for the Services provided.

10. Indemnification

Clients agree to indemnify and hold The Mercado Group harmless from any claims, losses, damages, liabilities, or expenses arising from their use of the Services or any breach of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of California. Any disputes arising from or related to these Terms shall be resolved exclusively in the courts of San Diego County.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective upon posting, and continued use of the Services constitutes acceptance of the revised Terms.
